General Terms and Conditions AeroGum®

1. Definitions

In these General Terms and Conditions:

  • AeroGum®: brand of AEROVÉ BV, Anninksweg 4A, 7557 AG, Netherlands, Chamber of Commerce 86746308.

  • Webshop: the online sales environment on www.aerogum.com where AeroGum® products are offered.

  • Products: all goods offered by AeroGum®, including the AeroGum® Airstick and interchangeable flavour cartridges.

  • User / Customer: any natural or legal person who visits the Webshop or purchases products.

  • Cartridges: Flavor cartridges offered by AeroGum®, filled with food-grade ingredients, 3rd party tested and REACH/GPSR compliant.

2. Applicability

2.1 These General Terms and Conditions apply to:

  • the use of the Webshop

  • all offers and sales of products via the Webshop

  • all legal relationships between AeroGum® and the customer.

2.2 By using the Webshop or purchasing a product, the customer agrees to these General Terms and Conditions.

2.3 Deviations from these General Terms and Conditions are only valid if confirmed in writing by AeroGum®.

3. Product information

3.1 The AeroGum® Airstick is a non-electrical, passive device for oral use.

  • It contains no battery or heating element and produces no smoke, vapor or aerosols.

  • The product is not a medical device and does not contain any active substances for absorption into the body.

  • The cartridges contain food-grade ingredients, independently tested for microorganisms and heavy metals.

3.2 The customer acknowledges that the product is exclusively intended for sensory, oral pleasure and not for inhalation or consumption.

3.3 Use of the product is at your own risk. AeroGum® is not liable for complaints or damage resulting from improper use, use contrary to the manual, or use by persons for whom the product is not suitable.

4. Age guideline

4.1 Marketing of the products is aimed at persons of 16 years and older.
4.2 The use of the products is recommended for adults (18+).
4.3 Customers are responsible for assessing whether the product is suitable for their situation and are responsible for complying with local laws and regulations.

5. Orders and agreements

5.1 An order via the Webshop is considered an customer offer to conclude a purchase agreement.
5.2 AeroGum® will confirm the order by email.
5.3 The agreement is concluded at the moment of confirmation by AeroGum®.
5.4 AeroGum® reserves the right to refuse or cancel orders, for example if fraud or sales to minors are suspected.

6. Prices and payment

6.1 All prices in the Webshop are inclusive VAT, unless otherwise stated.
6.2 Payment takes place via the payment methods offered on the Webshop.
6.3 AeroGum® reserves the right to change prices without prior notice.

7. Shipping conditions

7.1 AeroGum® will make every effort to dispatch orders as quickly as possible, but does not guarantee delivery times.
7.2 Delays due to carriers, customs or force majeure do not give rise to compensation.
7.3 For international orders, the customer is responsible for import duties, taxes and local regulations.
7.4 Risk of loss or damage during transport passes to the customer once the order has been handed over to the carrier.

8. Returns and right of withdrawal

8.1 In accordance with EU law, the right of withdrawal expires in the case of opened or used products. for hygiene reasons.
8.2 Only unopened and complete packages can be returned.
8.3 Return shipping costs are for the customer, unless otherwise required by law.

9. Liability

9.1 Use of the products is entirely at your own risk.
9.2 AeroGum® is not liable for:

  • direct or indirect consequential damage

  • personal injury or irritation

  • disappointment in taste or experience

  • damage due to misuse or non-original cartridges

9.3 To the extent permitted by law, AeroGum®’s liability is limited to the purchase price of the product.
9.4 Force majeure situations (such as natural disasters, pandemics, strikes, disruptions) exclude liability.

10. Intellectual Property

10.1 All rights, including trademark rights and copyrights on the Airstick, cartridges, Webshop and manuals, belong to AEROVÉ BV, trading as AeroGum®.
10.2 It is prohibited to copy, distribute or modify parts of the Webshop or manuals without written permission.

11. Privacy and data protection

11.1 Personal data are processed in accordance with the Privacy statement from AeroGum®.
11.2 By using the Webshop, the customer agrees to the collection and processing of personal data as described in the Privacy Statement.

12. Changes to the General Terms and Conditions

12.1 AeroGum® reserves the right to change these Terms and Conditions.
12.2 Changes will be published on the Webshop and will be binding from the moment of publication, unless stated otherwise.

13. Applicable law and disputes

13.1 These General Terms and Conditions apply Dutch law applicable.
13.2 Disputes will be submitted in the first instance to the competent court in the Netherlands.
13.3 Complaints can first be reported via support@aerogum.com before legal action is taken.
